Court Grants Discovery in Water Authority’s Rate Case Against MWD

San Francisco Superior Court Judge Richard A. Kramer today granted motions to allow discovery in the San Diego County Water Authority’s case against the Metropolitan Water District of Southern California, motions which MWD had vigorously opposed.  The judge also denied without prejudice MWD’s motion to bifurcate the case, saying he will consider how the case should be tried after the parties complete discovery.

Board votes to file appeal on preferential rights judgment

The San Diego County Water Authority board of directors voted to appeal the trial court's dismissal of the lawsuit against the Metropolitan Water District of Southern California to determine preferential rights to Metropolitan's water. The appeal is in response to San Francisco Superior Court Judge James J. McBride's judgment sustaining a demurrer filed by MWD against the Authority.

Public Records Reveal Eastern Municipal Water District Fronting San Diego Public Relations Campaign for Metropolitan Water District

Public records show the Eastern Municipal Water District in Riverside County is funding a $15,000-per-month public relations campaign in San Diego County on behalf of the Los Angeles-based Metropolitan Water District of Southern California.

While limited information was provided under the California Public Records Act, Eastern water district officials redacted key information and refused to release all records to the public, forcing the San Diego County Water Authority to file a lawsuit on January 22 to obtain the records.

Judge decides not to send preferential rights case to trial

San Francisco Superior Court Judge James J. McBride sustained a demurrer filed by the Metropolitan Water District of Southern California against a lawsuit filed by the San Diego County Water Authority regarding the formula Metropolitan uses to determine its member agencies' rights to water. Today's action by the court means the Authority's lawsuit is ended unless the Authority appeals to the Court of Appeal.

Water Authority Chair Responds to Court’s Validation of the QSA

Sacramento Superior Court Judge Lloyd G. Connelly on Wednesday entered a judgment validating the 2003 Colorado River Quantification Settlement Agreement and rejecting all of the remaining legal challenges to the landmark accord, in line with his tentative ruling in June. The final ruling secures a key component of water supply for the San Diego County Water Authority, which will receive 180,000 acre-feet of water this year as result of the QSA and related projects.
